Some features may be offered as beta or experimental versions. We do not guarantee the continued availability of beta features.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.

3. Eligibility

You must be at least 13 years old (or 16 years old where required by applicable data protection laws in your jurisdiction) to use the Services.

By using the Services, you represent and warrant that you meet this requirement.

4. User Accounts

Account Deletion

6. Intellectual Property

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, lawful purposes.

You may not:

• Remove proprietary notices

7. User Content

If you create or upload content within the Services:

• You retain ownership of your content
• You grant Creomobile a limited, worldwide, royalty-free, non-exclusive license to store, process, and display such content solely to provide the Services
• This license terminates when you delete your content or close your account, except where retention is required by law or necessary to resolve disputes

You are responsible for ensuring that your content does not violate applicable laws or third-party rights.

We reserve the right to remove content that violates these Terms or applicable law.

8. Subscriptions and Billing

Certain features of the Services may be offered on a paid subscription basis.

8.1 Pricing and Payment

Subscription pricing, billing frequency, renewal conditions, and applicable taxes will be clearly disclosed prior to purchase.

By purchasing a subscription, you authorize recurring billing through your selected payment method (e.g., Apple App Store, Google Play).

8.2 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date.

Renewal and cancellation terms are clearly disclosed before purchase.

You are responsible for managing your subscription settings within the applicable app store account.

8.3 Application-Specific Subscriptions

Subscriptions apply only to the specific Application in which they are purchased, unless explicitly stated otherwise.

8.4 Cancellation

You may cancel your subscription at any time via:

• Apple App Store: Settings → [Your Name] → Subscriptions
• Google Play: Play Store → Menu → Subscriptions

Cancellation prevents future billing but does not provide a proactive refund for the current billing period unless required by applicable law.

You will retain access to subscription features until the end of the current paid period.

8.5 Refunds

Refunds are handled exclusively in accordance with the policies of the platform where the purchase was made:

• Apple App Store – subject to Apple's refund policies
• Google Play – subject to Google's refund policies

We do not have the ability to process refunds for purchases made through third-party app stores.

8.6 Statutory Right of Withdrawal (Where Applicable)

If you are entitled under applicable consumer protection laws to a statutory right of withdrawal for digital services, such right shall apply.

By purchasing digital services and choosing to access them immediately, you expressly consent to the immediate performance of the services and acknowledge that you may lose your right of withdrawal once performance has begun, where permitted by applicable law.

9. Account Suspension and Termination

We may suspend or terminate your access to the Services immediately if:

• You violate these Terms
• Required by law
• Necessary to protect the security or integrity of the Services

You may terminate your account at any time in accordance with our Privacy Policy.

10. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, Creomobile disclaims all warranties, express or implied, including fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

Specific Disclaimer for Entertainment and Personalized Content

Certain features of the Services, including generated content, predictions, insights, and other personalized materials, are provided for entertainment purposes only.

Such content is intended for personal reflection and amusement, not as professional guidance.

Creomobile does not provide professional financial, legal, medical, psychological, or other expert advice.

We do not guarantee the accuracy, reliability, completeness, or predictive value of any content provided through the Services.

11. Limitation of Liability

To the maximum extent permitted by law, Creomobile shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Service interruptions

Total liability, if any, shall not exceed the greater of:

(a) the amount paid by you for the Services in the preceding 12 months; or
(b) EUR 100.

Nothing in these Terms limits liability for:

• Fraud or fraudulent misrepresentation
• Gross negligence or willful misconduct
• Violations of mandatory consumer protection laws
• Any liability that cannot be limited or excluded under applicable law

12. Third-Party Services

The Services may rely on third-party providers, including:

• Google Sign-In
• Apple App Store
• Google Play
• Hosting and infrastructure providers

We are not responsible for the availability, content, or policies of third-party services.

13. Mobile App Store Requirements

If you download the Services from the Apple App Store or Google Play:

• These Terms are solely between you and Creomobile, not with Apple Inc. or Google LLC.
• Creomobile is solely responsible for the Services and the content thereof.
• Apple and Google have no obligation to provide maintenance or support.
• Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the Operator is established, without regard to conflict of law principles.

Mandatory consumer protection laws in your country of residence may apply where they provide you with non-waivable rights.

14.2 Dispute Resolution

Where applicable, consumers in the European Union may access the European Commission's Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr

Consumers in other jurisdictions may have access to official dispute resolution platforms or consumer protection bodies as provided by applicable local laws.

15. Force Majeure

The updated version will be published with a revised Effective Date.

If you do not agree to the updated Terms, you must stop using the Services.

For material changes affecting your rights, we may provide additional notice (e.g., via email or in-app notification).

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

The invalid provision shall be replaced by a valid provision that most closely reflects the intent of the original provision.
